Congressman Williams Leads Letter to AG Garland Opposing the DOJ’s Lawsuit Against the State of Texas

WASHINGTON, D.C. – Congressman Roger Williams (TX-25) has led a letter, along with 20 members of the Texas Congressional Delegation, to Attorney General Merrick Garland expressing their concern and opposition to the Department of Justice's lawsuit against the State of Texas in relation to Senate Bill 4.

In the letter, Congressman Williams states, "Against all odds, Texas and Texans have stepped up in the fight to secure our border. If President Biden is not going to take responsibility for the invasion of our country, Texas must be allowed to protect itself without fear of retaliation. I, along with the members of the Texas Delegation, ask that the DOJ reconsider its harmful suit, but most importantly, it’s past time they do their job and secure our border."

The letter was also signed by Representatives Pat Fallon (R-Texas), Jake Ellzey (R-Texas), Dan Crenshaw (R-Texas), Keith Self (R-Texas), Chip Roy (R-Texas), Michael McCaul (R-Texas), Ronny Jackson (R-Texas), Lance Gooden (R-Texas), Pete Sessions (R-Texas), Beth VanDuyne (R-Texas), Michael Burgess (R-Texas), John Carter (R-Texas), Brian Babin (R-Texas), Morgan Luttrell (R-Texas), Monica De La Cruz (R-Texas), Randy Weber (R-Texas), Nathaniel Moran (R-Texas), Troy Nehls (R-Texas), Wesley Hunt (R-Texas), and Michael Cloud (R-Texas).

The controversy stems from the enactment of Senate Bill 4 on December 18th, 2023, by Governor Greg Abbott, which made illegal entry into or illegal presence in Texas a state crime. The Department of Justice filed a lawsuit against the state on January 3rd, 2024, challenging the constitutionality of Senate Bill 4.

The situation at the southern border has been a major concern since President Biden took office. As Congressman Williams highlights, there have been over 6.7 million encounters at the border since then.

In response to the ongoing issues at the border, this week Congressman Williams introduced the STOP Act. This act would affirm Texas' authority to take steps to secure its southern border in the event of inaction by the federal government.

The letter and Congressman Williams' efforts reflect the concerns of many Texas lawmakers regarding the Department of Justice's lawsuit against the state. The focus is on the need for Texas to be able to protect its borders and address the challenges posed by illegal immigration.
