Rep. Ben Bumgarner introduced HB 4265, a bill on Elections and Property Interests, to the Texas House on Tuesday, April 1 during the 89(R) legislative session, according to the Texas Legislature website.

The bill amends Chapter 209 of the Property Code to introduce processes for the recall of property owners' association board members and actions against board member violations. It allows owners with at least 20% of voting interests to petition for a special meeting to conduct a recall election for a board member. The recall election must occur within 90 days of petition receipt, and if successful, the board member's position is vacated immediately. Additionally, the bill permits property owners to bring legal action against board members violating the chapter or dedicatory instruments. If a justice of the peace finds a violation, they may order the board member's removal, award damages to the owner, or authorize the deduction of awarded amounts from future assessments. The owner must notify the association of their intent to take action 10 business days prior. The bill takes effect Sept. 1, 2025, and only applies to violations occurring after this date.
