More specifically, the official text was summarized by the state legislature as ’’Relating to the administration and enforcement by the Office of the Comptroller for Public Accounts against an appraisal district for a failure by a district to undertake corrective actions ordered by the Comptroller after review of the district's methods, appraisal standards and procedures’’.
The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.
This bill amends the Tax Code to enhance the enforcement authority of the Office of the Comptroller for Public Accounts over appraisal districts that fail to undertake corrective actions ordered by the comptroller. If an appraisal district does not substantially comply with the recommendations within one year from when a report is issued, the comptroller must ensure the implementation of these recommendations. By February 1 of the following year, the comptroller must assess compliance and inform the appraisal district of these findings. If noncompliance persists, the case will be referred to the Texas Department of Licensing and Regulation for further action, which may include imposing penalties or sanctions on the chief appraiser. The act repeals Section 1151.204(c)(1) of the Occupations Code and takes effect on Sept. 1, 2025.
Ben Bumgarner, member of the House Committee on Pensions, Investments & Financial Services, proposed another 24 bills during the 89(R) legislative session.
